1. About These Terms

These Terms and Conditions ("Terms") govern your use of Kiribati Direct services and website. By using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

2. Our Services

Kiribati Direct provides mail forwarding and package consolidation services, allowing customers to shop from international retailers and have their purchases delivered to Kiribati. Our services include:

  • Providing customers with a personal New Zealand shipping address
  • Receiving, storing, and processing packages at our Auckland warehouse
  • Package consolidation services to reduce shipping costs
  • International shipping from New Zealand to Kiribati
  • Package tracking and customer support

3. Account Registration

To use our services, you must create an account and provide accurate information including:

  • Full name and contact details
  • Valid delivery address in Kiribati
  • Phone number for delivery coordination

You are responsible for maintaining the confidentiality of your account and for all activities under your account.

4. Pricing and Payment

Service Fees: Registration is free. Shipping fees are calculated based on:

  • Tiered base fee: $5 (1 package), $10 (2-5 packages), $20 (6-10 packages), $50 (11-50 packages)
  • Weight-based charge varying by method:
    • Kiribati Direct Logistics: $18 NZD per kg
    • NZ Post Economy Plus: $22-26 NZD per kg (based on weight)
    • NZ Post Express: $28-58 NZD per kg (based on weight)
  • Billable weight is the greater of actual weight or volumetric weight

Payment: All fees must be paid before shipment dispatch. We accept bank transfers, e-wallet payments, and credit/debit cards via Stripe.

Additional Costs: Customers are responsible for any customs duties, taxes, or additional charges imposed by Kiribati authorities.

5. Prohibited Items

We cannot ship items that are:

  • Prohibited by New Zealand or Kiribati law
  • Dangerous goods (weapons, explosives, flammable materials)
  • Perishable items (food, plants, liquids)
  • Items restricted by shipping carriers
  • Illegal substances or counterfeit goods

6. Package Storage and Handling

Storage Period: Packages can be stored free of charge for up to 60 days from arrival at our warehouse.

Storage Fees: After 60 days, a storage fee of $2 NZD per day per package may apply.

Unclaimed Packages: Packages unclaimed after 90 days may be disposed of or donated at our discretion, with any associated costs charged to the customer.

Package Inspection: We reserve the right to inspect packages for security and compliance purposes.

7. Liability and Insurance

Standard Liability: Our liability is limited to the lesser of the item's declared value or $100 NZD per package, unless additional insurance is purchased.

Insurance Options: Optional shipping insurance is available for high-value items and is strongly recommended.

Exclusions: We are not liable for:

  • Delays caused by customs, weather, or circumstances beyond our control
  • Damage due to inadequate packaging by the original sender
  • Loss or damage to prohibited or restricted items
  • Consequential or indirect damages

8. Claims Process

Reporting: Claims for lost or damaged items must be reported within 7 days of delivery (or expected delivery date for lost items).

Documentation: Claims must include tracking numbers, proof of purchase, photos of damage, and any relevant documentation.

Investigation: We will investigate all claims and work with carriers to resolve issues.

Resolution: Valid claims will be resolved through repair, replacement, or compensation up to the coverage limit.

9. Fraud Prevention

Kiribati Direct has a zero-tolerance policy for fraudulent activity, including:

  • Use of stolen payment methods
  • Shipping prohibited or illegal items
  • Providing false information
  • Identity theft or impersonation

Accounts found to be engaged in fraudulent activity will be immediately terminated, and we will cooperate fully with law enforcement authorities.

10. Privacy and Data Protection

We are committed to protecting your privacy. Information about how we collect, use, and protect your personal data is detailed in our Privacy Policy. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Service Modifications

We reserve the right to:

  • Modify or discontinue services with reasonable notice
  • Update pricing with 30 days' notice to existing customers
  • Change these Terms with notification via email or website

Continued use of our services after changes constitutes acceptance of the modified terms.

12. Termination

Either party may terminate the service relationship at any time:

  • Customers may close their accounts and request package forwarding or pickup
  • We may terminate accounts for breach of these Terms or suspicious activity
  • Upon termination, customers remain responsible for all outstanding fees

13. Governing Law

These Terms are governed by New Zealand law. Any disputes will be resolved through negotiation, mediation, or in the courts of New Zealand. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
